broker services agreement

Starting January 1 2024, the agency statute, RCW 18.86 et seq takes effect.
The state of Washington's new agency law requires that a broker obtain a services agreement before or after rendering real estate brokerage services.

When you decide to collaborate with me, we'll enact an agreement, referred to as either Windermere Form 28.B or NWMLS Form 41. This agreement will establish the Agency and include the following provisions:

 

a. Acknowledgment: The buyer acknowledges receiving the pamphlet titled "Real Estate Brokerage in Washington." b. Broker Appointment: The firm appoints the mentioned broker(s) to represent the buyer. This agreement establishes an agency relationship with the broker(s) and any managing brokers from the firm overseeing them. The firm reserves the right to appoint additional brokers to represent the buyer. c. Agency Relationship: The relationship between the firm, broker, and buyer can be either "Exclusive" or not, as indicated. If marked as Exclusive, the buyer agrees not to engage in an agency relationship with other real estate firms or brokers during the specified term.
